Agreement; SPAM: (UNSOLICITED BULK EMAIL) The sending of spam (unsolicited bulk email) is not permitted. If you use ANY of OUR websites in any way to send spam, your membership will be terminated immediately, all commissions and downline Members will be LOST. Further if you send spam by some other method(s) and that transmission is in any way associated with your membership, your membership will be terminated immediately. If you use spam to promote any of OUR Products/Programs/Service, your membership and your account will be terminated immediately, and you will lose all pending and/or unpaid commissions. We are the sole judge and have final authority on what is to be considered spam. If you are wanting to do something that you think may even be remotely considered spam, contact us first to determine whether what you want to do is or is not considered spam. BOUNSES: We will be adding a 10% bounse on Monthly Sales, based on your having just 2 NEW Sales per month. These can not be on products YOU wish to buy for yourself, nor reacuring sales of Products/Services. If your referrer also has 2 NEW Sales, he/she will also recieve this same bounse on his/her Total Monthly Commissions. All unearned bounese and non-payable commissions become the property of The Coss Group. PRIVACY & SECURITY: Your Personal Referred Members do belong to YOU. But the Privacy & Security of ALL Members are on loan to The Coss Group and are protected. The Coss Group may at time SHARE the Membership information with a 3rd. party if this action is approved by the 10 member OVERSIGHT team. Your SPAMING any non personally referred Member with "any unrelated urls", and or e-mails containing or leading in anyway too any form of the following; ADULT / PORN / WAREZ / HACKING / ILLEGAL ACTIVITIES / HATE-RELATED SITES, or the use of OUR sites, chat rooms or promotion tools to promote any site related to adult content, porn, warez, hacking, illegal activities, hate-related sites, or any other website that is considered offensive to the general public is not allowed. Doing so will result in immediate termination of your membership. MISUSE OF PROMOTION TOOLS & BLASTERS: Misuse and/or abuse of the OUR promotion tools and/or blasters will result in immediate termination of your membership. The sending of email messages to the media & press and to publishers, without approval of content is not allowed. This could have a negative effect on other The Coss Group members, and overall it would devalue the The Coss Group membership benefits. Therefore you may not send ANY un-approved AD's with the use these blasters to send spam, garbage announcements, fictitious announcements, or any announcement related to porn, warez, hacking, illegal activities, or hate-related sites. We work with ISPs and anonymous proxy companies in order to detect fraud. PASSWORD SHARING CONSEQUENCES & MISCELLANEOUS: Password sharing is considered theft of services and is illegal. Password sharing can be detected. We are running and adding advanced systems which monitors IP numbers, thresholds, and five other parameters in order to determine whether a password is being shared. Sharing your password with another person will result in immediate termination of your membership. Further we may report some cases to the FBI Computer Crime Division, and we substantiate our reports so the FBI may investigate and prosecute. The FBI Computer Crime Division website states that ALL CASES OF FRAUD & COMPUTER CRIME ARE INVESTIGATED FULLY. Further anyone who shares their password with another person will be reported to a number of fraud databases. Many online commerce systems check these databases during an electronic transaction. Further we reserve the right to take legal action and other remedies against anyone who shares their password or commits any other computer crime or theft of services. AUTHORIZATION OF USE: by both members and non-members of download links are hear-by authorized a single license to download, copy, or print material found on The Coss Group and members site(s), and to use any online promotion tools within the terms of this agreement. This license shall granted for sole use via your computer(s) for your single and personal use only. All memberships are provided for personal use and shall not be used for any commercial purposes or by any commercial entities. Commercial use of either the site or any material found within is strictly prohibited, unless rights have been included as a trem of sale. No material within the site may be transferred to any other person or entity, whether commercial or non-commercial. In addition, materials may not be modified, or altered. Materials may not be displayed publicly, or used for any rental, sale, or display. Materials shall extend to copyright, trademarks, or other proprietary notices therefrom. The Coss Group reserves the right to terminate this license at any time if the terms of this agreement are breached. In the case that the terms are breached, you will be required to immediately destroy any information or material printed, downloaded or otherwise copied from The Coss Group members site. But may retain any products and rights you have BOUGHT. FINAL AUTHORITY: We are the sole judge and have final authority on what is to be considered spam, and abuse and misuse of The Coss Group members site. If you are wanting to do something that you think may even be remotely considered spam or misuse/abuse, contact us first to determine whether what you want to do is acceptable. Get any and ALL Ad copy approved. LIMITATION OF LIABILITY: We will not be liable for indirect, special or consequential damages, or any loss of revenue, profits or data, arising in connection with this Agreement or your membership or The Coss Group website, even if we have been advised of the possibility of such damages. NO GUARANTEES ON RESULTS: We makes no promises or guarantees on how The Coss Group members site and/or Products may affect your website visitor traffic or your financial success. NO GUARANTEES ON FUNCTIONALITY/UPTIME is possible. While it is our goal to have all areas of The Coss Group site(s) fully working during all times, 24 hours a day, 7 days a week, there may from time to time be a webpage, link, system, or tool which is not working. Once we learn of said problem we will attempt to correct the problem in a reasonably quick manner. To date we have had 99.99% uptime, however we make no guarantees on website functionality and/or uptime. SUPPLEMENTARY TERMS & CONDITIONS: The Coss Group members site may have additional Terms and Conditions that are an integral part of this Agreement, and are in addition to these Terms and Conditions. Such Terms and Conditions as listed at the The Coss Group members site will in no way invalidate any of the Terms and Conditions listed here. All Terms listed apply to The Coss Group and its members. I Terry W. Coss (sole owner of The Coss Group) do agree to the terms and conditions specified by the site(s) linked to this page. MODIFICATION(s): We may modify any of the terms and conditions contained in this Agreement, at any time and in our sole discretion, by posting a change notice or a new agreement on this site or in The Coss Group members site. If any modification is unacceptable to you, you have the right to terminate this agreement, and your membership at any time. Your continued participation as a member following our posting of a change notice or new agreement on our site will constitute binding acceptance of the change. TERM OF AGREEMENT: The term of this Agreement will begin upon our acceptance of your online application/order and will end when terminated by either party. Either you or we may terminate this Agreement at any time, with or without cause, by giving the other party notice of termination either in writing, by email, by telephone, or chat room notice. You are only eligible to earn referral fees on sales occurring during the term. CANCELLATION: At any time, and without cause, membership may be terminated at any time by either You, The Coss Group, or as required by Law, as per the terms in the above paragraph(s). SEVERABILITY: If any provision of this Agreement shall be held to be invalid or unenforceable for any reason, the remaining provisions shall continue to be valid and enforceable. If a court finds that any of this Agreement is invalid or unenforceable, but that by limiting such provision it would become valid or enforceable, then such provision shall be deemed to be written, construed, and enforced as so limited. INDEPENDENT INVESTIGATION YOU ACKNOWLEDGE THAT YOU HAVE READ THIS AGREEMENT AND AGREE TO ALL ITS TERMS AND CONDITIONS. YOU UNDERSTAND THAT WE MAY AT ANY TIME (DIRECTLY OR INDIRECTLY) SOLICIT CUSTOMER REFERRALS ON TERMS THAT MAY DIFFER FROM THOSE CONTAINED IN THIS AGREEMENT OR OPERATE WEB SITES THAT ARE SIMILAR TO OR COMPETE WITH YOUR WEB SITE. YOU HAVE INDEPENDENTLY EVALUATED THE DESIRABILITY OF PARTICIPATING IN THE PROGRAM AND ARE NOT RELYING ON ANY REPRESENTATION, GUARANTEE OR STATEMENT OTHER THAN AS SET FORTH IN THIS AGREEMENT. MISCELLANEOUS This Agreement will be governed by the laws of the United States and the State of Michigan, without reference to rules governing choice of laws. Any action relating to this Agreement must be brought in the federal courts located in Ann Arbor, Michigan, or state courts located in Jackson, Michigan and you irrevocably consent to the jurisdiction of such courts. You may not assign this Agreement, by operation of law or otherwise, without our prior written consent. Subject to that restriction, this Agreement will be binding on, inure to the benefit of and be enforceable against the parties and their respective successors and assigns. Our failure to enforce your strict performance of any provision of this Agreement will not constitute a waiver of our right to subsequently enforce such provision or any other provision of this Agreement. NOTICE: Notices by The Coss Group may be via any normal or electronic messaging means, or through The Coss Group members site(s), by a general posting on the The Coss Group members site, or by conventional mail. Notices to OUR members may be given by live chat, electronic messages, conventional mail, telephone or fax unless otherwise specified in the Agreement. All questions, complaints, or notices regarding the Market-It members site(s) must be directed to The Coss Group ONLY.
